Terms & Conditions For Tutors

1. Tutor's Responsibilities :  

1.01. A student can always cancel the booking, but only during the first 2 classes (Demo classes) . It is the Tutor's responsibility to impress and convince the student party with his/her teaching abilities and methods. Tutor should carry out the tutoring services in a professional manner with due skill, diligence and care.   

1.02. The Tutor is responsible for the content of lessons. These are to be carried out with proper preparation in accordance with a particular course of study, and in accordance with the Client’s instructions and/or relevant exam syllabus. Updates must be written after each session/class in the spreadsheet .  Tutor must also indicate his/her availability for Tuition classes on the spreadsheet.

  1.03. Tutor is responsible for keeping his/ her teaching record up to date . This is a standard record of all classes taught, which is to be signed by the Client after each month . If you don't  update after class or there is incorrect information on updates , your payment may be delayed. if tutor is unable to attend a scheduled class or If there is an emergency, tutor should inform about that class cancellation or rescheduling the class at a time agreeable to both parties .    

 1.04. Although Tutor has some teaching resources and may be able to support student / students by providing suitable materials, Tutor should be aware that he/she is responsible for providing all reasonable teaching materials. 

 1.05. Provided the Client gives clear prior consent in writing, the Tutor may obtain educational resources such as textbooks on behalf of the Client/Student . Drishti Home Tuition must be informed of any such arrangement to obtain educational resources, and will arrange reimbursement for the Tutor via invoice to the Client.  

  1.06. If the Tutor ceases to work with Drishti Home Tuition during a course of tuition, or ceases to work with a particular Student, either at their own behest or the behest of the Client, and the Student is continuing with their course of tuition from Drishti Home Tuition , the Tutor will draft a final report. This report will describe the work that the Tutor has done with the Student, and the work that remains to be done. It will describe the Student’s areas of strength and areas of weakness. The aim of the report will be to enable a new Tutor to pick up where the old Tutor stopped. 

 1.07.Tutor should  inform client 7 days in advance before he/she decides to stop teaching the student so that there will be enough time for client to find a replacement for the new tutor to take over. 

 1.08. Tutor must promote and support active and independent learning, develop a positive approach to learning , aid in developing higher academic competence and student confidence , create an encouraging environment where learning takes place at the student’s pace.  

1.09. Tutor understand that the final decision to choose a particular student for tuition is yours and yours alone and agree that you will teach the student if and only if at least one parent is present in the house . Any misconduct, misbehaviour, molestation, Bad Character complaint during tuitions hours shall be intolerable. Any such activity done shall be the teacher's responsibility.  

 2. Restrictions : 

 2.01. Tutor shall not punish the student in any condition .  

2.02. Tutor shall not market or sell any goods or services whilst communicating with a Customer in relation to a Tuition Session or whilst delivering a Tuition Session.   

2.03. Tutor will not use Mobile  whilst delivering a Tuition Session . 

3. Payment:  

3.01. Travel & Additional Expenses
As a tutor associated with Drishti Home Tuition, you are responsible for managing your own travel expenses to and from the tuition location. Drishti Home Tuition will not be liable for any travel, food, accommodation, or other incidental costs.

3.02. Cancellation After Initial Classes
If you discontinue tuition after attending only the first one or two classes, no payment will be made to you, even if the student or parents have already paid the fees in advance.

3.03. Minimum Teaching Commitment 

To ensure consistency and stability for students, tutors are required to commit to a minimum teaching duration of one month. If the tuition is discontinued within this period for any reason, no compensation will be provided.

3.04. Fee Distribution & Payment Process
For the first month of tuition, tutors will receive 60% of the total fees. The remaining 40% is retained by Drishti Home Tuition as a “Student Providing Charge.”

  • Payment for the first month will be made directly by Drishti Home Tuition.
  • From the second month onward, tutors may collect fees directly from the client at their own discretion. In such cases, Drishti Home Tuition will not be responsible for non-payment by the client.
  • Alternatively, tutors may opt for Drishti Home Tuition to handle fee collection, in which case payments will be released at the end of each month after deducting a 3% service charge.
  • Please note that no payment will be made for any leave or missed classes.

3.05. Tutor Commitment, Early Discontinuation & Penalties
Once a tutor is selected by a client, they must commit to teaching for at least one full month, with a mandatory 40% deduction applicable to the first month.

  • If a tutor provides a demo class, is selected by the client, and then refuses to continue without a valid reason, their profile will be negatively balanced by 40% of the first month’s fees. This balance must be cleared before new assignments are allotted.
  • If a tutor discontinues tuition within 1–12 days of commencement, no payment will be made, and their profile may be negatively balanced by up to 40% of the first month’s fees.
  • If a tutor completes 13–30 days of the first month, payment will be released after deducting fees equivalent to the first 12 days.

3.06. Payment Timeline
Tutors will receive their eligible payments at the end of each tuition month, ensuring timely and consistent payouts.

3.07. Client Discontinuation Policy
A client may discontinue tuition after completing one month without providing any reason. In such cases, the Student Providing Charge (40% of the first month’s fees) will remain unchanged and will not be refunded or adjusted.

4. Private Arrangements : 

4.01. In consideration of Drishti Home Tuition providing you with Students, you are not permitted to make private arrangements for tuition with Clients introduced by Drishti Home Tuition or with new Client introduced by Drishti Home Tuition ’ Clients. Should you breach this obligation, you will be liable to account to Drishti Home Tuition for all sums received by you from the Client/new Client without deduction and Drishti Home Tuition shall be entitled to obtain an injunction against you to prevent further breaches. This obligation shall continue notwithstanding termination or completion or other discharge of this Agreement.  

4.02.  Any work referred to a Tutor by a Client of Drishti Home Tuition must be billed through Drishti Home Tuition on your behalf. Drishti Home Tuition is willing to negotiate on commission for new Clients referred to you by our Clients but Drishti Home Tuition must process the billing and bookings must be through Drishti Home Tuition . 

4.03. The Tutor will not provide or agree to provide any services or carry out any work for the Client or the Student other than the Tuition, save with the prior consent of Drishti Home Tuition .  

5. Liability :   

5.01. Drishti Home Tuition does not accept any liability for any claims by the Client arising out of or related to the carrying out of the tutoring by you and you agree to indemnify Drishti Home Tuition without limit in respect of any such claims.  

5.02. Drishti Home Tuition shall have no liability to the Tutor for any loss, damage, expenses, payments or injury which the Tutor may incur arising from the security or state or condition of any premises in which the Tuition is provided or from any act or omission of the Client, the Student or any third party occurring on any such premises or otherwise during the course of or in connection with the provision of the Tuition. 

5.03 Drishti Home Tuition  shall have no liability for any loss or damage arising directly or indirectly from any act or omission of the Tutor. The Tutor shall indemnify the Company and keep the Company fully and effectively indemnified on demand against any actions, claims, costs, losses, damages, expenses, liabilities and payments which may be brought against or suffered or incurred by the Company as a result of or in connection with, directly or indirectly, the provision of the Tuition by the Tutor, any act or omission by the Tutor, and any breach or non performance of these Terms or the Terms of the Agreement between the Tutor and the Client by the Tutor.   

5.04. Drishti Home Tuition shall not be responsible for the same under any consequences. In such cases legal course of action of account of victims shall be applicable to accused.    

6. Document Requirements , Honesty and Precision : 

6.01. In order to provide the best tutoring experience, we require our tutors to provide us a few important documents. These include a photo of their Aadhar card as a proof of identity, a photo of their 12th marksheet, and if applicable, a photo of their graduation marksheet or all certificates of their qualifications mentioned in the joining form. Additionally, if you are an experienced tutor, we would appreciate it if you could submit experience certificates to verify your teaching experience. We will inform you when these documents are needed for verification purposes.

6.02. The Tutor promises and ensures the Company that all their verbal and written statements and information shared with the Company for the purpose of Tuition, including (but not limited to) personal details about the Tutor and their qualifications, identification, credentials, references, and suitability for Tuition are, and will continue to be, truthful, comprehensive, and accurate.

6.03. In the event of any change in the information originally shared, such as a conviction after document verification, the Tutor agrees to promptly inform the Company so that the information provided about themselves remains truthful and precise.

7. Confidentiality And Non-Disclosure Agreement : 

7.01. The Tutor undertakes that he/she  will not at any time during or after the conclusion of this agreement, disclose to any person any confidential information concerning the business, affairs, customers, clients or suppliers of Drishti Home Tuition , except that you may disclose Drishti Home Tuition’s confidential information as may be required by law, court order, or any governmental or regulatory authority. 

7.02. The Tutor undertakes not to make use of confidential information encountered through association with Drishti Home Tuition for any purpose other than to perform your obligations under this Agreement.  

7.03. Tutor agrees to hold in confidence and keep confidential any and all confidential information that I receive from the Company, the Company’s customers, and prospective customers (including students, learners, institutions, companies, and other entities). 

7.04. Tutor agree to not disclose any confidential information to any third party (including other applicants, potential applicants or independent contractors, or the general public) and agree to not use such information for any purpose except to assist any student during a tutoring session.  

7.05. Tutor agrees to compensate the Company for losses it incurs as a result of his/her negligent, reckless, or intentional disclosure of Confidential Information, meaning that tutor will pay for any damages tutor causes, including legal costs.  

7.06. Confidential information includes : 

7.06.01.  Any information, idea or concept, in any form (tangible or intangible), whether disclosed to tutor or learned by tutor concerning students, patrons, teachers, learners, employees, and other applicants, independent contractors, or guests using the service including but not limited to information concerning their age, sex, sexual orientation, religious affiliation, ethnicity, national origin, ancestry, disability, or other personally identifiable information;  

7.06.02. All information of a competitively sensitive nature, including trade secrets or confidential or proprietary information of any sort, including, without limitation, information relating to subject exams and subject exam questions, writing sample questions, products, processes, policies and procedures, designs, formulas, developmental or experimental work, computer programs, databases, or other original works of authorship, customer lists, business plans, financial information or other subject matter pertaining to any business of the Company; and  Confidential information also includes all information concerning Company policies, strategies, finances, pricing, legal documents, pay rates, use of independent contractors, and the nature of relationships between corporate management and its service providers, customers, and end users - including the specific questions such users ask while using the Company’s services. For the purposes of this Agreement, the term “keep confidential” includes sharing confidential information verbally, in written form .  

7.07. Legal Action ( IT act 2000 ) : 

Section 72. Penalty for breach of confidentiality and privacy :-  Save as otherwise provided in this Act or any other law for the time being in force, any person who, in pursuance of any of the powers conferred under this Act, rules or regulations made thereunder, has secured access to any electronic record, book, register, correspondence, information, document or other material without the consent of the person concerned discloses such electronic record, book, register, correspondence, information, document or other material to any other person shall be punished with imprisonment for a term which may extend to two years, or with fine which may extend to one lakh rupees, or with both. The aforesaid section has a limited application only. It confines itself to the acts and omissions of those persons, who have been conferred powers under this Act Rules or Regulation made there under . 

Section 72 of the Act relates to any person who, in pursuance of any of the powers conferred by the Act or its allied rules and regulations has secured access to any: 

i) Electronic record, 

ii) book, 

iii) Register, 

iv) Correspondence, 

v) Information,

vi) Document, or vii) Other material. If such person discloses such electronic record, book, register, correspondence, information, document or other material to any other person, he will be punished with imprisonment for a term, which may extend to two years, or with fine, which may extend to two years, or with fine, which may extend to one lakh rupees, or with both. This section applies only to person who has gained access to the abovementioned information in pursuance to a power granted under Information Technology Act, its allied rules e.g. a police officer, the Controller etc. it would not apply to disclosure of personal information of a person by a website, by his email service provider etc.

Disclosure of Your Information:

Service Providers: We may disclose your information to service providers who work on our behalf to provide you with our services.

Legal Reasons: We may disclose your information if we are required to do so by law or if we believe in good faith that such action is necessary to comply with legal requirements or to protect the rights, property, or safety of Drishti Home Tuition, our users, or others.

Security:

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.

Changes to This Policy:

We may change this policy from time to time. If we make any changes, we will update the policy on our website.
